These Terms and Conditions ("Terms") govern your use of the website fertilityessentials.us and the Fertility Essentials mobile application (the "Site" and "App") operated by Fertility Essentials ("we", "us", or "our"). Please read these Terms carefully before accessing or using our services.
Fertility Essentials operates through two registered businesses: Fertility Essentials, registered in Ghana, and Fertility Essentials LLC, registered in the United States. Your contract for any order is with Fertility Essentials, the Ghana-registered business, which is the seller of all products and the party responsible for fulfilment, returns, and refunds under these Terms.
Fertility Essentials LLC is the publisher of record for the App on the Apple App Store and appears there as the App's seller. It is not the seller of the products you order, and these Terms do not create a contract between you and Fertility Essentials LLC in respect of any order.
1. Acceptance of Terms
By accessing or using the Site or App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not use our services.
2. Use of the Site and App
You may use our services for lawful purposes only. You agree not to use the Site or App in any way that violates any applicable laws or regulations.
3. Products and Services
We sell dietary supplements and teas for hormonal imbalance and fertility support. By placing an order, you agree to pay the specified price for the products and any applicable taxes or shipping fees.
4. Payment
Secure checkout through Hubtel; available payment methods are shown before payment. By providing your payment information, you authorize us to charge the total amount due to your designated payment method.
5. Shipping
DHL, across Ghana and internationally. We will make every effort to ship orders promptly, but we cannot guarantee delivery dates. Shipping times and charges vary by destination and the live options shown at checkout.
6. Returns and Refunds
Contact us within 30 days of delivery. Products must be unopened, unused and in original packaging. Customer pays return shipping. Damaged or defective items will be replaced at our expense.
7. Intellectual Property
The content on the Site and App, including text, graphics, logos, images, and software, is the property of Fertility Essentials and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or transmit any content without our prior written consent.
8. Health Disclaimer
The information provided on the Site and App is for general informational purposes only and is not intended as medical advice. We make no representations or warranties about the accuracy, reliability, or suitability of the information provided.
These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. The cycle tracking feature is not a medical device and should not be used as birth control. Always consult a healthcare provider for medical decisions.
9. Limitation of Liability
In no event shall Fertility Essentials be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of the Site, App, or the products purchased through our services.
10. Indemnification
You agree to indemnify and hold harmless Fertility Essentials, its officers, directors, employees, and agents, from any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of your use of our services or violation of these Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to update or change these Terms at any time without prior notice. Any changes will be effective immediately upon posting the updated Terms on the Site.
